Leapseed, Co. (“Leapseed,”“Malek.chat,”“we,” “us,” “our”) provides its services (described below) to you through its website located at Malek.chat (the “Site”) and through its mobile applications and related services (collectively, such services, including any new features and applications, and the Site, the “Service(s)”), subject to the following Terms of Service (as amended from time to time, the “Terms of Service”). We reserve the right, at our sole discretion, to change or modify portions of these Terms of Service at any time. If we do this, we will post the changes on this page and will indicate at the top of this page the date these terms were last revised. We will also notify you, either through the Services user interface, in an email notification or through other reasonable means. Any such changes will become effective no earlier than fourteen (14) days after they are posted, except that changes addressing new functions of the Services or changes made for legal reasons will be effective immediately. Your continued use of the Service after the date any such changes become effective constitutes your acceptance of the new Terms of Service.

Please be advised: These Terms of Service contains provisions that govern how claims between you and Malek.chat can be brought (SEE THE DISPUTE RESOLUTION BY BINDING ARBITRATION SECTION BELOW). These provisions will, with limited exception, require you to:  1) waive your right to a jury trial, and 2) submit claims you have against Malek.chay to binding and final arbitration on an individual basis, not as a plaintiff or class member in any class or representative action or proceeding, and 3) you will only be permitted to seek relief (including monetary, injunctive, and declaratory relief) on an individual basis. Please review The Dispute Resolution by Binding Arbitration section (below) for further details and your options.

When using certain aspects of the Services or using certain Services, you will be subject to any additional terms applicable to such services that may be posted on the Service from time to time, including, without limitation, our Privacy Policy and Help Center. All such terms are hereby incorporated by reference into these Terms of Service.

Eligibility

• Age Requirements: You must be at least 18 years old to use Malek.chat. If you’re under 18, your parent or guardian must review and consent to these Terms on your behalf.
• Parent/Guardian Permission: Users under 18 need permission from a parent or legal guardian. For registration, we may contact your parent or guardian to verify consent.

Account Registration and Security

• Information Accuracy: Users must provide accurate and complete information during registration. Accounts are for individual use, and sharing account credentials is not permitted.
• Parental Oversight: Parents or guardians can monitor account activity via our Parent Dashboard. Any issues or concerns can be flagged for further review.

Permitted and Prohibited Uses

• Allowed Uses: Malek.chat is intended for educational and entertainment purposes, promoting safe and responsible use of AI technology. Users are encouraged to explore the content and engage with interactive features within the scope of age-appropriate, safe learning.
• Restricted Actions: Users may not:

• Use Malek.chat for any harmful, illegal, or inappropriate purposes.
• Attempt to decompile, reverse engineer, or otherwise interfere with the Services.
• Violate intellectual property or privacy rights of others.
• Circumvent any safeguards, including content filters designed for child safety.

• Third-Party Services: Some features may link to third-party services, governed by their terms. Malek.chat does not assume responsibility for third-party content.

Content Ownership and Use

• User Content: Users retain ownership of any original content they contribute (Input). By submitting content, users grant Malek.chat permission to use it solely for service improvement and operational support.
• Platform Output: Malek.chat provides educational content (“Output”) that is intended for informational purposes. Malek.chat does not guarantee complete accuracy, and users are encouraged to verify the information independently where appropriate.
• Parental Controls: Parents may opt out of certain content-sharing practices via the Parent Dashboard. Details on content use are outlined in our Privacy Policy.

Fees and Billing

• Subscription Services: Certain features may require a paid subscription. Fees and billing details will be provided upon selection. Parents may cancel subscriptions at any time, subject to our refund policy.
• Changes to Pricing: We may modify our pricing with 15 days’ notice. If you disagree with a price change, you may cancel the subscription.

Termination and Suspension

• User-initiated Termination: You may delete your or your child account at any time.
• Platform Suspension: We reserve the right to suspend or terminate accounts if these Terms are violated, especially in cases where usage poses a potential safety risk.
• Inactive Accounts: Accounts inactive for over a year may be closed following an advance notice.

Intellectual Property Rights

Malek.chat retains exclusive ownership of all proprietary content, features, and functionalities within the Service. This ownership respects and does not conflict with the intellectual property rights of any open-source tools, code, or models utilized in developing the platform. Any unauthorized use, reproduction, distribution, or modification of Malek.chat’s content or features is strictly prohibited

Open Source Resources

Malek.chat integrates open-source AI models, code, and tools, which are transparently listed at Malek.chat/opensource. By using Malek.chat, you agree to comply with the privacy policies, terms, and conditions of these open-source resources as an integral part of this agreement. Your use of the Service signifies acknowledgment and adherence to these external terms.

Dispute Resolution

• Informal Resolution: We encourage users to contact us first to resolve any issues informally.
• Arbitration: All disputes related to these Terms or the Services will be settled by binding arbitration in accordance with local laws, except in cases involving claims for injunctive relief.

Limitation of Liability

Malek.chat is provided “as is,” with no express warranties for uninterrupted or error-free service. Malek.chat is not liable for indirect, incidental, or consequential damages. Liability is capped at the greater of the subscription cost for the preceding 12 months or $100, where legally permitted.

Indemnification

If you are using Malek.chat on behalf of a business or organization, you agree to indemnify and hold Malek.chat and its affiliates harmless from any claims or liabilities arising from your use of the platform.

Disclaimer of Warranties

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. MALEK.CHAT EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

MALEK.CHAT MAKES NO WARRANTY THAT (I) THE SERVICE WILL MEET YOUR REQUIREMENTS, (II) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (III) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, OR (IV) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS.

Changes to Terms

We may update these Terms to reflect operational changes, regulatory requirements, or technological advancements. Significant changes will be communicated 30 days in advance, and continued use signifies acceptance.
